Terms of Service
The terms for ordering at a restaurant that uses Servly.
1. What Is Servly?
Servly is ordering and billing software run by VortekAI Solutions ("Servly", "we", "us"). When you scan a QR code at a restaurant that uses Servly, you can see its menu and send your order from your phone. These terms apply when you use Servly to order.
2. Nature of the Relationship
The restaurant sells you the food
- Servly provides the ordering and billing software that the restaurant uses.
- The restaurant is the seller of the food. Servly does not prepare, handle or deliver food.
- The restaurant is solely responsible for its menu, prices, the taxes shown, food quality and safety, preparation time, service charge and refunds.
- The restaurant is also responsible for any dispute about your meal.
- When you place an order through Servly, you make a contract with the restaurant, not with Servly.
- You pay the restaurant, not Servly.
3. Your Personal Data
Our Privacy Policy explains what personal data we collect, how we use and share it, and your rights. It forms part of these terms. When you place an order, the restaurant receives your order details, and your name and contact details if you signed in.
4. Using Servly
- Account: You can order as a guest. If you create an account, you must be 18 or older. You sign in with a one-time code sent to your email. Keep the code to yourself; you are responsible for activity on your account.
- Orders: The restaurant's staff may need to accept your order before the kitchen sees it. Once confirmed, orders cannot be cancelled through Servly. You can add items to an open dine-in order; to change or remove an item, ask the restaurant.
- Prices: The restaurant sets its prices, taxes and any service charge. Amounts shown before billing are estimates. The restaurant's final bill decides what you pay.
- Payments: You pay the restaurant directly, at the counter or at your table, by cash, UPI or card. Servly does not take or process your payment.
- Acceptable use: Do not use Servly for fraudulent orders, impersonation, harassment, interfering with the service, or anything unlawful under Indian law.
5. Service Availability and Errors
Servly is provided "as is" and "as available". Like any software, it may contain errors, interruptions, delays or inaccuracies, including in displayed prices or order status. We use reasonable efforts to correct issues we become aware of. We give no warranty that Servly will be uninterrupted or error-free.
Subject to Section 6, we are not liable for loss arising from such issues. We are also not liable for misuse of Servly by a restaurant, its staff or another diner. For a problem with your order, your remedy lies with the restaurant.
6. Limitation of Liability
Servly is not responsible for food quality, preparation, hygiene, preparation time, or any health issue arising from food. To the extent the law allows, Servly's total liability to you for any claim about an order will not exceed the value of that order. We are not liable for indirect or consequential loss, such as loss of time, opportunity or goodwill.
Nothing in these terms limits liability for fraud or gross negligence, death or personal injury caused by negligence, or any liability or right that cannot be limited under applicable law, including your rights under the Consumer Protection Act, 2019.
7. Suspension
We may block an order, a device or an account that we reasonably believe is being used for fraud, abuse or unlawful purposes, or that puts the service or other users at risk.
8. Third-Party Services
Servly relies on services we do not control, such as your internet connection and device, your payment app, and our hosting and email providers. We are not responsible for their failures. Links to other websites are provided for convenience; their own terms and privacy policies apply.
9. Events Outside Our Control
We are not liable for any delay or failure caused by events outside our reasonable control. Examples are power or internet failures, natural disasters, epidemics, government action and failures of third-party providers.
10. Changes to These Terms
We may change these terms by posting a new version on this page with its effective date. If you keep using Servly after that date, you accept the new version.
11. Governing Law and Disputes
These terms are governed by the laws of India. Subject to your right to approach a consumer commission, the courts at Ahmedabad, Gujarat have jurisdiction.
